Distance Sales Agreement

1. PARTIES

This Distance Sales Agreement (“Agreement”) has been concluded electronically between the Seller, whose details are provided below, and the Buyer purchasing through www.ashwickers.com.

BUYER

The Buyer’s name, surname, address, telephone number and email address consist of the information provided during the ordering process.

2. SUBJECT

The purpose of this Agreement is to determine the rights and obligations of the parties concerning the sale and delivery of products electronically ordered by the Buyer through the Seller’s website at www.ashwickers.com, in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

3. PRODUCTS

The following information regarding the product or products included in the order forms an integral part of this Agreement, as specified in the order summary:

4. CONCLUSION OF THE AGREEMENT

The Buyer acknowledges that, before completing the order, they have been informed about the product’s essential characteristics, sales price, payment method, delivery conditions and right of withdrawal.

The Agreement becomes effective when the Seller electronically confirms the order.

5. PAYMENT

Payment may be made by credit card, debit card or any other payment method offered on the website.

The products will not be dispatched until the full order amount has been collected.

6. DELIVERY

Unless otherwise stated, orders will be dispatched to the delivery address provided by the Buyer within no more than 30 days following payment approval.

Ashwickers aims to prepare and dispatch orders as quickly as possible. Estimated delivery times may also be specified on the website.

The Seller shall not be responsible for delays caused solely by the shipping carrier, except where otherwise required by applicable law.

7. RIGHT OF WITHDRAWAL

The Buyer may exercise the right of withdrawal without providing a reason within 14 days of receiving the product.

For the return process to be completed properly:

The product must not have been used beyond what is reasonably necessary to inspect its nature and operation.
The product should be returned in its original packaging.
The product should remain suitable for resale, subject to the Buyer’s statutory rights.
All included accessories must be returned completely.

The right of withdrawal must be communicated to the Seller by email or another legally accepted durable medium.

The returned product must be sent using the shipping method communicated by the Seller.

Where the return conditions are satisfied, the product price will be refunded within the statutory period using the Buyer’s original payment method.

8. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal may not apply to the following products, subject to applicable legislation:

Products prepared or personalised according to the Buyer’s specific requests,
Products unsuitable for return for health or hygiene reasons where protective packaging has been opened,
Products damaged or rendered unsuitable for resale through use exceeding reasonable inspection,
Other exceptional products and services specified by applicable legislation.

9. DEFECTIVE PRODUCTS

If a delivered product is found to be defective, the Buyer may exercise the statutory remedies available under applicable consumer protection legislation.

10. FORCE MAJEURE

The parties shall not be held responsible for failure to fulfil their obligations due to natural disasters, war, epidemics, strikes, decisions of public authorities, transportation interruptions or similar circumstances beyond their reasonable control.

11. PERSONAL DATA

The Seller processes the Buyer’s personal data in accordance with the Turkish Personal Data Protection Law and other applicable legislation.

12. DISPUTES

For disputes arising from this Agreement, Consumer Arbitration Committees shall have jurisdiction within the monetary limits announced annually by the Turkish Ministry of Trade. Consumer Courts shall have jurisdiction for disputes exceeding those limits, subject to applicable procedural requirements.
